Wilhelmus Schutt – children of Daniel Sparks

Berkshire SS To the honorable court of probate now hold in at Lenox within and for the said county, Wilhelmus Schutt of Mount Washington represents and gives the court to understand that Abigail now the wife of Chester Schutt of said Mount Washington, is an heir to the estate of Asa Sparks late of Sheffield, deceased, testator as a representative of her father Daniel Sparks, deceased, who was a son of the said Asa, that the said Abigail and her husband are under the age of twenty one years, is the father and natural guardian of the said Chester. He also represents, that Maria Sparks and Angeline Sparks are also heir to the estate of the said Asa as representatives of their father, the said Daniel, that they reside out of this commonwealth and are minors without any guardian. He also represents that Lavina Sparks, a minor above the age of fourteen years, and daughter of the said Daniel and an heir as aforesaid living in Sheffield in said county has not a guardian. He also further states to this court that there is estate belonging to said minors which descended to them from the said Asa as representatives of their said father, which is necessary should be secured for their benefit. He therefore prays that he may be appointed guardian of the said Abigail and Chester her husband and the said Maria and Angelina residing out of this commonwealth. So far as may relate to their said estate and that the said Lavina may be cited to choose a guardian according to law to enable them all to unite in claiming possession of their said estate. April 6^th 1819

Berkshire SS. At a court of probate begun and holden at Lenox within aforesaid county on the sixth day of April A.D. 1819, before the Hon William Walker, judge of said court, the foregoing petition being received and oath being made by the above named Wilhelmus Schutt to the truth of the facts therein stated. It is there upon ordered and decreed that the said Wilhelmus Schutt be appointed guardian unto the above named Chester Schutt & Abigail his wife according to his choice and also unto Maria Sparks and Angeline Sparks so far as it relates to any estate which has descended to them from Asa Sparks late of Sheffield in Berkshire County deceased testate as the heirs and legal representatives of Daniel Sparks, deceased, son of said Asa.

At the said court Wilhelmus Schutt of Mount Washington in the county of Berkshire is chosen and allowed to be guardian unto Chester Schutt and Abigail his wife who are minors. The said Chester being a son of the said Wilhelmus and the said Abigail a daughter of Daniel Sparks late of Sheffield, deceased, so far as relates to any estate which has descended to them the said Chester or Abigail from Asa Sparks, the grandfather of the said Abigail, late of said Sheffield, deceased; and a bond is taken of the said Wilhelmus for the discharge of his said trust as on file.

Surety, Merritt Smith Esq., of Mount Washington and John Ward, minor Owen and Zacheus Candy all of said Sheffield are appointed appraisers of said estate.

At the same court Wilhelmus Schutt of Mount Washington in the county of Berkshire, is appointed to be guardian unto Maria Sparks and Angeline Sparks minor children of Daniel Sparks late of Sheffield in said county, deceased, (who reside out of this commonwealth,) so far as relates to any estate which has descended to them from their grandfather, Asa Sparks late of said Sheffield, deceased, and a bond is taken of the said Wilhelmus for the discharge of his said trust, as on file.

Surety, Merritt Smith Esq., of said Mount Washington and John Ward, minor Owen and Zacheus Candy all of said Sheffield are appointed appraisers of said estate.

To the Hon. Wm Walker, judge of probate of wills for the county of Berkshire, humbly shows Merritt Smith guardian of Martin Charles Chapin and Abigail Chapin, the children of David Chapin late of Salisbury in the state of Connecticut, deceased, and Wilhelmus Schutt guardian of Abigail Schutt a minor the wife of Chester Schutt, also a minor, and Maria Sparks and Angeline Sparks, the said Abigail, Maria and Angeline being the children of Daniel Sparks, late of Sheffield, deceased, that the said minors are interested in the estate of Asa Sparks, late of said Sheffield, deceased, and that Benjamin Sparks, the executor of the last will and testament of said Asa hath not settled his account of administration, wherefore your petitioners pray that the said Benjamin may be cited to settle the account as executor of the last will and testament of Asa.

The foregoing petition being received and considered it is thereupon ordered and decreed by said judge that the Benjamin Sparks, --- hereby is cited to appear at a court of probate to be holden at the probate office in Lenox on Wednesday next after the first Tuesday of May next at ten o’clock in the _____.
